You scanned this from a cap. That is on purpose.

Yes, this was bait. You pointed a camera at a stranger, and the stranger pointed you straight here. Now you know how it feels to be captured without being asked.

If you are reading this, you most likely filmed, photographed or recorded the person wearing this cap, or you are about to. They do not consent to it.

This page is their formal, visible objection. By wearing it in plain sight, they have made that objection known to you before you press record.

Why this matters legally

When someone is identifiable in your photo or video, that footage is their personal data. Filming it, and especially posting it online, is processing of personal data under the EU GDPR (Regulation 2016/679).

Article 21 GDPR. The right to object. A person has the right to object to the processing of their personal data. The objection does not need a special form. This cap is that objection, made clearly and in advance.

The "personal or household use" exemption does not protect you when the content is shared publicly, posted to social media, monetised, or used to build a following. In those cases the full GDPR applies to you as the person doing the recording.

What it can cost you

This goes beyond the GDPR. In the Netherlands, publishing a recognizable image can breach portrait rights (Auteurswet art. 21). The person shown can demand removal and claim damages.

It can also be a criminal offence. In certain situations, secretly filming someone or sharing such footage is punishable under the Dutch Criminal Code (Wetboek van Strafrecht art. 139f and 139h).

What happens next

If you publish this anyway, the path is short, and it names you.

A demand to delete, sent to you.
A takedown to the platform, which is obliged to act.
A complaint to the Autoriteit Persoonsgegevens, with this dated objection as evidence.
A civil claim for removal and damages.

The platform is not on the hook. Meta is not. You are. Every step is in your name, because you are the one who pressed record.

What this means for you

Do not film, photograph or publish images of this person. If you already did, delete them. If you share them anyway, you are knowingly ignoring a documented objection, which strengthens any complaint they may file.

This objection is published and dated. It existed before your recording did.

Je scande dit van een pet. Dat is met opzet. De drager geeft geen toestemming om gefilmd, gefotografeerd of opgenomen te worden.

Sta je iemand met deze pet op je opname, dan was het bezwaar zichtbaar en vooraf kenbaar. Onder de AVG (artikel 21, recht van bezwaar) is een identificeerbaar persoon in beeld een persoonsgegeven, en filmen plus publiceren is verwerking. De huishoud-uitzondering geldt niet zodra je het deelt, online zet of er een publiek mee opbouwt.

Wat het je kan kosten. Dit gaat verder dan de AVG. Het publiceren van een herkenbaar beeld kan het portretrecht schenden (Auteurswet art. 21): de afgebeelde persoon kan verwijdering eisen en schade claimen. In bepaalde gevallen is heimelijk filmen of het delen ervan strafbaar (Wetboek van Strafrecht art. 139f en 139h).

Wat er daarna gebeurt, en het noemt jou: een sommatie tot verwijdering aan jou gericht, een takedown bij het platform dat verplicht is te handelen, een klacht bij de Autoriteit Persoonsgegevens met dit gedateerde bezwaar als bewijs, en een civiele claim tot verwijdering en schadevergoeding.

Het platform is niet aansprakelijk. Meta niet. Jij wel. Elke stap staat op jouw naam, want jij drukte op opnemen.

Film of publiceer deze persoon niet. Heb je het al gedaan, verwijder het. Doe je het toch, dan negeer je bewust een vastgelegd bezwaar, en dat versterkt een eventuele melding bij de Autoriteit Persoonsgegevens.

Dit bezwaar is gepubliceerd en gedateerd. Het bestond al voordat jouw opname bestond.
